1. Export policy
Machinery and equipment are not items banned from export or subject to conditional export specified in Clauses 1 and 2, Article 5 and Appendix I of Decree No. 187/2013/ND-CP of the Government regulating the List goods banned from export and import. Therefore, businesses can export machinery and equipment as normal goods.
2. HS code and export tax
Machinery and equipment industry has HS Code in chapters 84 and 85:
- Chapter 84: List of HS Codes for boilers, machinery, mechanical equipment,…
- Chapter 85: List of HS Codes of electrical machines, image and sound recorders and reproducers,…
Export taxes on machinery and equipment that businesses need to pay attention to are as follows:
- VAT: 10%.
- Preferential export taxes will have separate rates depending on the specific type of machinery.
3. Customs documents for exporting machinery and equipment
The customs dossier for exporting machinery includes the following documents:
- Commercial Invoice – Commercial invoice
- Packing List – Goods packing list
- Bill of Lading – Bill of lading
- C/O – Certificate of origin of goods
- Other positions (depending on the type of machinery and equipment)
In addition, for used machinery and equipment, businesses need to prepare the following documents:
- Certificate of inspection of used machinery and equipment from the inspection organization
- Manufacturer’s confirmation of year of manufacture and production standards
4. Some notes when exporting used machines
- The lifespan of used machinery and equipment must not exceed 10 years. Normally it will be in the range of 5 – 10 years.
- The inspection certificate must comply with TCVN or QCVN regulations and must meet criteria such as energy saving, safety according to the standards of the importing country and environmental protection.
- Enterprises are required to fully present:
- Assembly diagram if the device is separate.
- Detailed information about the manufacturer and machine stamp.
- Synchronous inspection certificate.
- Operation diagram of the machine and other parts.
